Welcome to Moonpath (“the App,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of the App and any related services, content, and features. By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. Intended Use

The App is designed for family-friendly entertainment and experiences that may be enjoyed by children under the supervision of a parent or legal guardian. Certain content or features may require a paid subscription to access. The App is intended to be used responsibly and in accordance with all applicable laws and platform rules.

2. Parent or Guardian Responsibility

Parents and guardians are responsible for supervising their child’s use of the App and determining whether the App is appropriate for their child. The App may include content, stories, interactive experiences, or AI-generated materials intended for general family audiences.

3. No Account Required

The App does not require users to create an account or provide an email address in order to access core functionality. We may use platform-based purchase and subscription systems provided by Apple or Google to manage subscriptions and purchases.

4. Subscription Services

Certain features or content may require an active paid subscription. Subscriptions are billed through your Apple App Store or Google Play account and are governed by the applicable platform’s billing terms and conditions. Subscriptions automatically renew unless canceled through your platform account settings before the renewal date. We do not control and are not responsible for payment processing performed by Apple, Google, or other third-party payment providers.

5. Adult Verification

Certain purchases or subscription actions may require users to complete a simple verification step intended to confirm that a parent or adult is authorizing the transaction. By completing a purchase, you represent that you are legally authorized to use the selected payment method and to enter into the transaction.

6. Privacy

Your use of the App is also governed by our Privacy Policy. The App is designed to minimize the collection of personal information and does not require users to create personal accounts to use core features. We may collect limited technical and usage information necessary for app functionality, analytics, subscription validation, security, and performance improvement.

7. Acceptable Use

You agree not to:

• Misuse or interfere with the App;
• Attempt to reverse engineer or disrupt the App;
• Use the App in violation of applicable laws;
• Upload or transmit harmful, abusive, or unlawful material;
• Attempt unauthorized access to systems or services connected to the App.

We reserve the right to suspend or restrict access to the App for violations of these Terms.

8. Intellectual Property

The App, including its software, artwork, designs, stories, audio, branding, trademarks, and other content, is owned by or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any portion of the App without prior written permission.

9. Third-Party Platforms and Services

The App may rely on or integrate with third-party services, including Apple App Store, Google Play, analytics providers, and cloud infrastructure providers. We are not responsible for the availability, security, or practices of third-party services.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the App will always be uninterrupted, error-free, secure, or available.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount paid by you to us through the App during the twelve (12) months preceding the claim.

12. Changes to the App or Terms

We may update, modify, suspend, or discontinue portions of the App at any time. We may also update these Terms from time to time. Continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
